MyProf.mu – Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MyProf.mu website, applications, and services (collectively, the "Platform"). By accessing or using MyProf.mu, you agree to be bound by these Terms.
If you do not agree, you must not use the Platform.
1. Who We Are
MyProf.mu ("MyProf", "we", "us", "our") is a Mauritian online tutoring marketplace that connects students and parents ("Students") with independent tutors ("Tutors") for online or in‑person lessons, exam preparation, and related educational services.
MyProf is a platform provider, not an employer of Tutors. Tutors act as independent contractors.
2. Eligibility & Accounts
2.1 Eligibility
- You must be at least 18 years old to create a Tutor account.
- Students under 18 must have a parent or legal guardian create and manage their account, or explicitly consent to use of the Platform.
- By using MyProf.mu, you represent that you have legal capacity to enter into these Terms.
2.2 Account Registration
- You must provide accurate, current, and complete information during sign up.
- You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activities under your account.
- You agree to promptly update your information if it changes (e.g. email, phone number, payment details).
2.3 Account Types
- Student account – for students and/or parents booking sessions.
- Tutor account – for tutors offering educational services. Tutors may be subject to additional verification and onboarding requirements.
We may refuse, suspend, or terminate any account if we reasonably believe you have violated these Terms or applicable law.
3. Nature of the Platform
3.1 Marketplace Role
MyProf provides tools for:
- Searching and discovering Tutors.
- Messaging and booking sessions.
- Managing availability, payments, and dispute resolution.
MyProf does not:
- Guarantee any specific academic outcome, grade, or exam result.
- Control Tutors' teaching methods, materials, or schedules, beyond platform rules.
- Supervise lessons in real time.
3.2 Independent Tutors
Tutors are independent service providers, not employees or agents of MyProf.
Tutors are solely responsible for:
- Complying with tax obligations and business registration requirements.
- Ensuring they have the right to provide tutoring services in Mauritius.
- Accuracy of their profile, qualifications, and experience.
- Compliance with exam and school integrity policies.
4. Use of the Platform
4.1 Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose, including exam cheating or academic dishonesty.
- Harass, abuse, or discriminate against any user.
- Share or post content that is defamatory, obscene, hateful, or infringing.
- Circumvent the Platform by arranging off‑platform payments for students you discovered on MyProf.
- Reverse‑engineer the Platform, interfere with security features, or attempt to gain unauthorized access.
4.2 Content You Provide
- You retain ownership of content you submit (e.g. messages, profile information, reviews).
- By uploading content, you grant MyProf a worldwide, non‑exclusive, royalty‑free license to use, display, and reproduce that content as necessary to operate and promote the Platform.
- You warrant that:
- You have the rights to submit the content.
- Your content does not infringe third‑party rights.
We may remove or modify content that breaches these Terms or applicable law.
5. Bookings, Sessions & Cancellations
5.1 Booking a Session
- Students select a Tutor, time slot, session type (Regular / Express / Trial), and provide any required details.
- A booking is confirmed once payment is authorized and the Tutor accepts (if applicable).
5.2 Session Types
- Regular sessions – standard length (e.g. 60–90 minutes) for ongoing support.
- Express sessions – short, focused sessions (e.g. last‑minute exam help).
- Trial sessions – introductory lessons, often at a discounted rate.
Specific durations and rates are shown at booking time.
5.3 Student Cancellations & Rescheduling
- You can cancel or reschedule via the dashboard, subject to each Tutor's policy and MyProf's platform rules.
- Late cancellations or no‑shows may:
- Forfeit all or part of the session fee.
- Affect your eligibility for certain promotions or features.
Exact policies are displayed during booking; by confirming a booking you accept those terms.
5.4 Tutor Cancellations & No‑Shows
If a Tutor cancels or fails to attend:
- Students may receive a full refund or credit, or be offered free rescheduling.
- MyProf may take corrective action, including adjusting Tutor ratings or suspending accounts for repeated issues.
6. Payments, Pricing & Subscriptions
6.1 Pricing
- Tutors set their own rates within platform guidelines.
- MyProf may recommend benchmarks or minimum/maximum rates but does not guarantee any earnings or pricing level.
- All prices are generally shown in Mauritian Rupees (MUR) unless stated otherwise.
6.2 Payments & Escrow
- Payments are processed by secure third‑party providers (e.g. Stripe, local gateways, mobile wallets).
- For eligible sessions, funds may be held in escrow:
- Released to the Tutor after the session is completed and any dispute window passes.
- Refunded or partially refunded if a valid dispute is resolved in the Student's favour.
6.3 Platform Fees & Commission
- MyProf charges Tutors a commission on completed, paid sessions.
- Commission rates may vary by:
- Subscription tier (Basic / Professional / Premium).
- Session type (Regular / Express / Secure Payment).
- The effective commission will be displayed in the Tutor dashboard.
6.4 Tutor Subscriptions
- Tutors may opt into paid subscription plans (Basic / Professional / Premium) to access:
- Increased visibility and placement.
- AI matching and automation features.
- Priority support, analytics, and reduced commission (per plan details).
- Subscriptions generally:
- Renew automatically on a monthly basis until cancelled.
- Are billed via card or other available methods.
- Cancellation takes effect at the end of the current billing period; no partial refunds unless required by law.
7. Disputes Between Students & Tutors
7.1 Opening a Dispute
- Students can open a dispute through their booking page (e.g. if a lesson did not take place or was substantially below expectations).
- Tutors can respond and provide evidence (messages, materials, attendance records, etc.).
7.2 Review & Resolution
MyProf will review:
- Booking details, communication logs, and submitted evidence.
- Tutor's historical performance and prior disputes.
MyProf may decide to:
- Issue a full or partial refund.
- Release funds to the Tutor.
- Offer re‑booking or credits.
MyProf's decision is final within the Platform and does not limit your rights under Mauritian law.
8. Reviews & Ratings
- Students may leave ratings and textual reviews after sessions.
- Reviews must be honest, respectful, and based on real experiences.
- We may:
- Remove reviews that are abusive, irrelevant, or clearly false.
- Use aggregated ratings to award or revoke badges (e.g. Top Rated Tutor).
9. Intellectual Property
MyProf owns all rights in:
- The Platform, design, branding, and software.
- Aggregated data and analytics derived from usage (in anonymized form).
You may not:
- Copy significant parts of the Platform UI/UX or backend.
- Use MyProf trademarks without prior written permission.
10. Data Protection & Privacy
Our use of your personal data is governed by the MyProf.mu Privacy Policy, which forms part of these Terms. By using the Platform, you consent to our collection and processing of your data as described there.
11. Disclaimers
- MyProf provides the Platform "as is" and "as available".
- We do not warrant that:
- The Platform will be uninterrupted, error‑free, or completely secure.
- Any particular Tutor will meet your expectations or guarantee exam results.
- To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non‑infringement.
12. Limitation of Liability
To the extent permitted by law:
- MyProf is not liable for:
- Loss of profits, revenues, or business.
- Loss of data or reputation.
- Indirect, incidental, special, or consequential damages.
- Our total aggregate liability for any claim arising out of or related to the Platform will not exceed the total amount of platform fees you paid to us in the 3 months preceding the event giving rise to the claim.
Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, or death/personal injury caused by negligence where such limitation would be unlawful.
13. Termination & Suspension
We may suspend or terminate your access to the Platform if:
- You breach these Terms or any policy referenced here.
- We suspect fraud, abuse, or unlawful activity.
- We are required to do so by law, a court, or regulator.
You may stop using the Platform at any time and can request account closure via support, subject to completion of any pending bookings and payouts.
14. Changes to the Terms
We may update these Terms from time to time. If changes are material, we will provide notice (e.g. via email or in‑app). Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
15. Governing Law & Disputes
- These Terms are governed by the laws of the Republic of Mauritius.
- Any disputes arising from or relating to the Platform that cannot be resolved amicably shall be submitted to the competent courts of Mauritius, without prejudice to any mandatory consumer protection laws.
